By accessing or using our tutoring services, you (the “Client”, “Parent/Guardian”, or “Student”) agree to be bound by these Terms and Conditions. If you do not agree, you must not use our services.
- Services Provided
We offer online tutoring services to students from Kindergarten to Year 10, including assistance in literacy, numeracy, science, and other school curriculum subjects, delivered via secure video conferencing platforms.
- Eligibility
- Students must be residents of Australia.
- Students under the age of 18 must have parent or legal guardian consent to enrol and participate in lessons.
- Parents or guardians must complete registration and payment on behalf of students under 18.
- Booking & Scheduling
- Sessions must be booked in advance via our online booking system or by contacting us directly.
- Availability is subject to tutor scheduling and may change with notice.
- We reserve the right to reschedule or cancel a session with reasonable notice.
- Fees & Payment
- One free trial session is available.
- Fees are charged per term or via a pre-paid package plan.
- All prices include GST where applicable.
- Payments must be made in advance through secure online payment methods.
No refunds will be issued for missed sessions.
- Cancellations & Refunds
- If we cancel a session, clients may choose between a refund or rescheduled session.
- Child Protection & Safety
- Online sessions are conducted in a safe, respectful, and appropriate environment.
- Parents/guardians are encouraged to supervise online sessions for younger students.
- Inappropriate behaviour by a student or parent may result in termination of services without refund.
- Code of Conduct
- Students must behave respectfully during lessons.
- No offensive language, bullying, or disruptive behaviour is tolerated.
- Repeated misconduct may result in suspension or termination of tutoring services.
- Privacy & Confidentiality
- We comply with the Privacy Act 1988and the Australian Privacy Principles (APPs).
- We collect personal information only to deliver educational services.
- Personal data is stored securely and is not shared without consent, except as required by law.
- Sessions may be recorded for quality and training purposes with prior consent.
- Intellectual Property
- All learning materials provided are the intellectual property of Ozsmart or its licensors.
- Clients may not reproduce, distribute, or share any materials without written permission.
- Limitation of Liability
- We make every effort to ensure accurate and helpful tutoring support.
- We are not liable for any academic outcomes, grades, or school performance.
- Our maximum liability for any claim is limited to the amount paid for the affected service.
- Changes to Terms
We may update these Terms and Conditions from time to time. Clients will be notified of any significant changes. Continued use of services after such updates constitutes acceptance of the new terms.
- Governing Law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
